Do not file Copyright Claim if the content is already in public domain, or you did publish it in the past under "Creative Commons Attribution license (reuse allowed). Or, if you are not willing, or cannot, provide verifiable proof of Identity and Copyright ownership. In case of Agent filing claim, both Agent and Copyright holder(s) must provide verifiable proof of identity. Rather, file a dispute if you object to publication of content.

If you are a copyright owner or an agency and believe that any content published on a Channelstreem platform infringes upon your copyrights, you may submit a notification pursuant to the Digital Millennium Copyright Act ("DMCA") by providing our Copyright Administrator with the following information in writing (see 17 U.S.C 512(c)(3) for further detail):

A- A physical or electronic signature along with your proof of positive identification or of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;

B- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single platform or multiple Channelstreem platforms are covered by a single notification, a representative list of such copyrighted works at each platform; Identifying the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled and information reasonably sufficient to permit the Copyright Administrator to locate the claimed listed material;

C- Contact information to permit the Copyright Administrator to verify your identity and reach you to keep you informed of the progress, such as an address, mobile telephone number, and email;

D- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and

E- A statement that the information in the notification is accurate, and submitted under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

F- A Certified copy of the claimed Copyright form filed with any Official Intellectual Property Office such as USPTO or equivalent worldwide to validate your claim.

G- You may direct copyright infringement notifications by Certified or any other trackable mail delivery to: Channelstreem Corporation, attention: Copyright Administrator at 1309 Coffeen Ave, Suite 1200, Sheridan, Wyoming (WY), USA 82801. No email or fax contact available for this notification. You acknowledge that if you fail to comply with all of the requirements of this Section (5) your DMCA notice may not be valid.




Rebuttal and Counter Notice.


If you believe that your uploaded content that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to publish and use the material in your content, you may send a counter-notice containing the following information to the Copyright Administrator (same as above):


A- Your physical or electronic signature;

B- Identification of the published content that has been removed or to which access has been disabled and the platform and category at which the content appeared before it was removed or disabled;

C- A statement that you have a good faith belief that the published content was removed or disabled as a result of mistake or a misidentification of the content; and

D- Your name, address, telephone number, and e-mail address, a statement that you will accept service of process from the person who provided notification of the alleged infringement if you are located in the United States.

E- If a counter-notice is received by the Copyright Administrator, Channelstreem may send a copy of the counter-notice to the original complaining party informing that person that it may replace the removed content or cease disabling it in 7 business days. Unless the copyright owner files an action seeking a court order against the infringed content publisher, member or user and mail a copy of such legal court action to Copyright Administrator at the address mentioned above. The removed content may be replaced, or access to it restored within 7 to 10 business days (or more) after receipt of the counter-notice, at Channelstreem sole discretion.




Fair Use Clause.

Each country has own Copyright laws. In United States, the Copyright Law allow for fair use of copyrighted content such as visual and performing arts, among other mediums. However, there are various measures used to determine if particular infringement or use of Copyrighted work may fall under the Fair Use Clause. Usually, there are four factors that determine fair use: (a) The purpose of the use, if it is for commercial profit or is for nonprofit educational purposes. (b) The nature of copyrighted work, using material from fact of nature, real world, or using material from work created entirely from someone imagination. (c) How much of the copyrighted work is used, is it just for reference or substantial portion. (d) Would the act of copy from copyrighted work effect in derogatory ways the copyright owners’ profit and reputation.


There are misconceptions among the general public about the Fair Use, such as the believe that posting a disclaimer will make the use fair, or that giving credit to copyright owner will qualify as fair use, that is only true if copyright owner gave permission to do so and required credit notification, stating that the copyrighted work used for entertainment or non-profit uses only, or that once substantially altered the copyrighted work with added original material my use is fair use. None of these examples qualify automatically as fair use. Courts will look carefully and take into account various facts to evaluate whether the use was fair or not.
