Channelstreem Corporation Platforms Terms of Service January 1, 2025
These Terms of Service covers all of Channelstreem platforms, including this one. By signing in or using this and/or any of Channelstreem Corporation platforms you fully understand and agree to the Terms of Service regulating your signup and use of this and all Channelstreem online media platforms.
These Terms of Service apply to all users of Channelstreem platforms, including users who are also content producers on the platforms. “Content” includes text, software, graphics, photos, sounds, music, videos, audiovisual combinations, interactive comments and likes indicators, and other materials you may view on, access through, or contribute to any of the platforms. Channelstreem platforms may contain links to third party websites that are not owned or controlled by Channelstreem and assumes no responsibility for, the content, privacy policies, or practices of any third party websites. In addition, none of Channelstreem platforms can censor or edit the content of any third-party site. By using the Channelstreem platforms, you expressly relieve Channelstreem Corporation from any and all liability arising from your use or contribution to any of its platforms or third party URL links landing pages.
Channelstreem may, in its sole discretion, modify or revise these Terms of Service and policies at any time, and you agree to be bound by such modifications or revisions. Nothing in these Terms of Service shall be deemed to confer any third-party rights or benefits. You should periodically review the most up-to-date version of this Term of Service Agreement by checking the date of the latest revision.
Global Infrastructure:
To enable user global access to Channelstreem platforms and operate our global service, we need to store and distribute content, data servers and data centers around the world, including some outside your country of residence. This infrastructure may be operated or controlled by Channelstreem Corporation, , its affiliates or a third party.
Advertising:
We show you advertisements, sponsored videos, images, and editorial contents to help you discover products and services that are offered by the many businesses and organizations that use Channelstreem Media Platforms. Commercial concerns pay Channelstreem for advertisements to cover cost of operating the platforms and help Content Producers to show their content to you regularly. This will offset their expense and time, making it worthwhile for them to provide content of interesting quality. Channelstreem Platforms are designed so that each platform shows the specific sponsored content your life style desire and are of interest and relevance to you to see as useful and informative. The category you select determine the type and nature of advertisements shown to you.
No Algorithms or Data Retention Policy:
Your utmost privacy, safety, and security are the most important factors in the purpose build-specific use design and operation of Channelstreem platforms. We provide these platform services without the usage of any algorithms’, collecting, storing or using any of your personal data. Positive real identification is required to become a Content Producer, start a channel or make use of comment section. However, other than the email address and SMS telephone number you provide for verification, nothing else is collected by any of Channelstreem Platforms. Your SMS telephone number is not shared with anyone and is not stored on any server or computer unless you manually choose to list such by selecting the public options settings. We may place a cookie on your computer but this is not to track your activities online, only to recognize you when you visit the same Channelstreem platform and login again. .
Using or Publishing Content on Channelstreem platforms:
1-Sign up and starting a channel
Consider all Channelstreem platforms as private property. You can use the property as long as you adhere to the Terms of Service. Your content must be is interesting, in demand, and your presence is profitable to the platform. All Channelstreem platforms regulate the signup process of Content Producer members on the basis of invitation only. You may only signup to use the platform as Content Producer if you were invited to do so. If you wish to receive an invitation code to any of Channelstreem Platforms to start a Channel or post as Content Producer contact us by mail or email at the contact information listed at the bottom of this page. Include in your request your real name, the content you intend on publishing, language and country, any link(s) to existing material published. If approved, you will receive an invitation code good for 90 days. You can start uploading and publishing in accordance of these terms of service which you acknowledge that you read, understand and agree to all terms:
Use real identity in conjunction with screen or channel name.
Users and content producers must provide accurate information about themselves or the organization, cause or Commercial concern they represent or promote.
Only 2 Channels per SMS telephone number allowed.
You must be over 13 years of age to use or publish content on Channelstreem platforms.
Users are solely responsible for the activity that occurs on their Channel, and must keep account credential secure and not share it with anyone.
Must notify Channelstreem immediately of any breach of security or unauthorized use of account. Although Channelstreem will not be liable for users losses caused by any unauthorized use of any account, users may be liable for the losses of Channelstreem and or others due to such unauthorized use.
2-Permissions and Restriction:
Users may not alter or modify the platform in anyway not permissible by Channelstreem.
Users may not access content through API, spiders, offline readers, or any other mean other than the platform functionalities. May not access any of Channelstreem Platforms in a manner that sends more request messages to the platforms servers in a given time than manually can be produced in the same period of time using web-browser.
Users may not upload viruses or malicious code or do anything that could disable, overburden, or impair the proper working or appearance of any of Channelstreem Platforms.
Users may not sell any advertising, sponsorships, or promotions on any page of an ad-enabled blog or website containing Channelstreem platforms content, unless other material not obtained from Channelstreem sources appears on the same page and is of sufficient value to be the basis for such sales.
Users agree to comply with all applicable laws.
Users agree that Channelstreem reserves the right to discontinue any functionality of the platforms at any time.
Users may not use the platforms or contents to promote activities that are unlawful, misleading, or fraudulent. Or publish content that infringes or violates someone else’s rights.
User understand that when using any of Channelstreem platforms, user will be exposed to published content from a variety of sources, and that Channelstreem is not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such published content. User further understand and acknowledge that user may be exposed to uploaded and published content that is inaccurate, offensive, indecent, or objectionable, and therefore user agree to waive, and hereby do waive, any legal or equitable rights or remedies user have or may have against Channelstreem Corporation with respect thereto, and, to the extent permitted by applicable law, agree to indemnify and hold harmless Channelstreem Corporation, its owners, shareholders, administrators, directors, operators, employees, contractors affiliates, licensors, and licensees to the fullest extent allowed by law regarding all matters related to your use of any and all use of Channelstreem platforms.
3-Uploading content to Channelstreem platforms and acceptable usage conduct.
Channelstreem Platforms refers to websites located globally on various servers, operating under various jurisdictions, these Term of Use are valid on all Channelstreem Platforms including, but not limited to: artstreem.com, brandstreem.com, channelstreem.com, citystreem.com, golivestreem.com, pagestreem.com, pixstreem.com, trendstreem.com, wordsstreem.com, vlogstreem.com, xyzstreem.com.
As a Channelstreem content producer user may submit content to a Channelstreem platform,including videos and user comments. User understands that Channelstreem does not guarantee any confidentiality with respect to any content submitted.
User shall be solely responsible for own content and the consequences of submitting and publishing content on the Platforms. User affirm, represent, and warrant that user own or have the necessary licenses, rights, consents, and permissions to publish the content submitted; and user agree to grant irrevocable license to Channelstreem Corporation to all patent, trademark, trade secret, copyright or other proprietary rights in and to such content for publication on the Channelstreem platforms pursuant to these Terms of Service user agreed to it.
User retains all ownership rights in the content. However, by submitting content to a Channelstreem platform, user hereby grant Channelstreem Corporation a worldwide, non-exclusive, royalty-free, sublicenseable and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the content in connection with the publication on any of Channelstreem platforms and Channelstreem's (and its successors' and affiliates') business, including without limitation for promoting and redistributing part or all of the platforms (and derivative works thereof) in any media formats and through any media channels. User also hereby grant each user of the platforms a non-exclusive license to access user content published through the platforms, and to use, reproduce, distribute, display and perform such content as permitted through the functionality of the platforms and under these Terms of Service. The above licenses granted by user in video, picture or text content submitted to the platforms terminate within a commercially reasonable time after removal or deletion of said content from the platform(s). User understand and agree, however, that Channelstreem Corporation may retain, but not display, distribute, or perform, server copies of videos, picture and text content that have been removed or deleted. The above licenses granted by user in user comments submitted are perpetual and irrevocable.
User further agree that content submitted by user to any Channelstreem platform will not contain third party copyrighted material, or material that is subject to other third party proprietary rights, unless user have permission from the rightful owner of the material or users are otherwise legally entitled to post the material and to grant Channelstreem all of the license rights granted herein.
User further agree that user will not submit to Channelstreem platforms any content or other material that is contrary to Channelstreem Guidelines, and user agree that these guidelines may be updated from time to time, user agree not to submit for publication to any of Channelstreem Platforms content that are contrary to applicable local, national, and international laws and regulations.
Chanelstreem will process any content comprised of text, images or audio or audiovisual content uploaded by user to the platforms in accordance with Channelstreem Data Processing Terms.
Channelstreem does not endorse any content submitted to any of Channelstreem platforms by any user or other licensor, or any opinion, recommendation, or advice expressed therein, and Channelstreem expressly disclaims any and all liability in connection with such uploaded content. Channelstreem does not permit copyright infringing activities and infringement of intellectual property rights on the platforms, and Channelstreem will remove all content if properly notified that such content infringes on another's intellectual property rights. Channelstreem reserves the right to remove content without prior notice.
4. Account Suspension and Termination
Channelstreem will terminate a user's access to to platforms if, under appropriate circumstances, the user is determined to be a repeat infringer. Channelstreem reserves the right to decide whether content violates these Terms of Service for reasons other than copyright infringement, such as, but not limited to, pornography, obscenity, or excessive length. Channelstreem may at any time, without prior notice and in its sole discretion, remove such content and/or terminate a user's account for submitting such material in violation of these Terms of Service.
5. Digital Millennium Copyright Act
If you are a copyright owner or an agency and believe that any content published on a Channelstreem platform infringes upon your copyrights, you may submit a notification pursuant to the Digital Millennium Copyright Act ("DMCA") by providing our Copyright Administrator with the following information in writing (see 17 U.S.C 512(c)(3) for further detail):
A- A physical or electronic signature along with your proof of positive identification or of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
B- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single platform or multiple Channelstreem platforms are covered by a single notification, a representative list of such copyrighted works at each platform; Identifying the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled and information reasonably sufficient to permit the Copyright Administrator to locate the claimed listed material;
C- Contact information to permit the Copyright Administrator to verify your identity and reach you to keep you informed of the progress, such as an address, mobile telephone number, and email;
D- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
E- A statement that the information in the notification is accurate, and submitted under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
F- A Certified copy of the claimed Copyright form filed with any Official Intellectual Property Office such as USPTO or equivalent worldwide to validate your claim.
G- You may direct copyright infringement notifications by Certified or any other trackable mail delivery to: Channelstreem Corporation, attention: Copyright Administrator at 1309 Coffeen Ave., Suite 1200, Sheridan, Wyoming (WY) 82801USA. No email or fax contact available for this notification. You acknowledge that if you fail to comply with all of the requirements of this Section (5) your DMCA notice may not be valid.
6. Rebuttal and Counter Notice.
If you believe that your uploaded content that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to publish and use the material in your content, you may send a counter-notice containing the following information to the Copyright Administrator (same as above):
A- Your physical or electronic signature;
B- Identification of the published content that has been removed or to which access has been disabled and the platform and category at which the content appeared before it was removed or disabled;
C- A statement that you have a good faith belief that the published content was removed or disabled as a result of mistake or a misidentification of the content; and
D- Your name, address, telephone number, and e-mail address, a statement that you will accept service of process from the person who provided notification of the alleged infringement if you are located in the United States.
E- If a counter-notice is received by the Copyright Administrator, Channelstreem may send a copy of the counter-notice to the original complaining party informing that person that it may replace the removed content or cease disabling it in 7 business days. Unless the copyright owner files an action seeking a court order against the infringed content publisher, member or user and mail a copy of such legal court action to Copyright Administrator at the address mentioned above. The removed content may be replaced, or access to it restored within 7 to 10 business days(or more) after receipt of the counter-notice, at Channelstreem sole discretion.
7. Fair Use Clause.
Each country has own Copyright laws. In United States, the Copyright Law allow for fair use of copyrighted content such as visual and performing arts, among other mediums. However, there are various measures used to determine if particular infringement or use of Copyrighted work may fall under the Fair Use Clause. Usually, there are four factors that determine fair use: (a) The purpose of the use, if it is for commercial profit or is for nonprofit educational purposes. (b) The nature of copyrighted work, using material from fact of nature, real world, or using material from work created entirely from someone imagination. (c) How much of the copyrighted work is used, is it just for reference or substantial portion. (d) Would the act of copy from copyrighted work effect in derogatory ways the copyright owners’ profit and reputation.
There are misconceptions among the general public about the Fair Use, such as the believe that posting a disclaimer will make the use fair, or that giving credit to copyright owner will qualify as fair use, that is only true if copyright owner gave permission to do so and required credit notification, stating that the copyrighted work used for entertainment or non-profit uses only, or that once substantially altered the copyrighted work with added original material my use is fair use. None of these examples qualify automatically as fair use. Courts will look carefully and take into account various facts to evaluate whether the use was fair or not.
- Warranty Disclaimer.
User agrees that use of the Platforms shall be at user sole risk. To the fullest extent permitted by law, Channelstreem Corporation, its officers, directors, employees, and agents disclaim all warranties, express or implied, in connection with Channelstreem platforms and the use of any one of such. Channelstreem makes no warranties or representations about the accuracy or completeness of any of its platform content or the content of any page linked to it and assumes no liability or responsibility for any errors, mistakes, or inaccuracies of content, as well as personal injury or property damage, of any nature whatsoever, resulting from user access to and use of our Platforms. Furthermore, assumes no liability or responsibility for any unauthorized access to or use of our secure servers and/or any and all personal information and/or financial information stored therein, for any interruption or cessation of transmission to or from our platforms as a result of any bugs, viruses, trojan horses, or the like which may be transmitted to or through our platforms by any third party. Additionally, any errors or omissions in any content or for any loss or damage of any kind incurred as a result of the use of any content publisher, uploaded or otherwise made available via the platforms. Chnnelstreem does not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or offered by a third party through the platforms or any hyperlinked services or featured in any banner or other advertising, and Channelstreem will not be a party to or in any way be responsible for monitoring any transaction between users and third-party providers of products or services, or with the purchase of a product or service through any medium or in any environment. User should use best judgment and exercise caution where appropriate.
9. Limitation of Liability
In no event shall Channelstreem Corporation, its officers, directors, employees, or agents, be liable to you for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever resulting from any (a) errors, mistakes, or inaccuracies of content, (b) personal injury or property damage, of any nature whatsoever, resulting from user access to and use of our platforms, (c) any unauthorized access to or use of our secure servers and/or any and all personal information and/or financial information stored therein, (d) any interruption or cessation of transmission to or from our platforms, (e) any bugs, viruses, trojan horses, or the like, which may be transmitted to or through our platform by any third party, and/or (f) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any published or transmitted content, or otherwise made available via the platforms, whether based on warranty, contract, tort, or any other legal theory, and whether or not Channelstreem Corporation is or was advised of the possibility of such damages. The foregoing limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction.
User specifically acknowledges that Channelstreem Corporation shall not be liable for content or the defamatory, offensive, or illegal conduct of any third party and that the risk of harm or damage from the foregoing rests entirely with users. The platforms is controlled and offered by Channelstreem Corporation from its facilities worldwide. Channelstreem makes no representations that any of its platforms is appropriate or available for use in any location. Users who access or use the Platforms from jurisdictions, location or country do so solely at their own will and are responsible for compliance with local law. - Indemnity
To the extent permitted by applicable law, user agree to defend, indemnify and hold harmless Channelstreem Corporation, its corporate officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (a) use of and access to the service; (b) user violation of any term of these terms of service; (c) user violation of any third party right, including without limitation any copyright, property, or privacy right; or (d) any claim that a user content caused damage to a third party. This defense and indemnification obligation will survive these terms of service and your use of the platforms.
11. Ability to accept terms of service
User affirm that user is either more than 18 years of age, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these terms of service, and to abide by and comply with these terms of service. In any case, user affirms that user is over the age of 13. If users are under 13 years of age, then please do not use any of Channelstreem platforms.
12. Assignment
These terms of service, and any rights and licenses granted hereunder, may not be transferred or assigned by user, but may be assigned by Channelstreem without restriction.
13. Global Jurisdiction
User agree that: (a) for the purpose of determining Jurisdiction, the platforms shall be deemed based Globally; and (b) the platforms shall be deemed to function as a passive internet based website that does not give rise to personal or specific legal jurisdiction over the platform, the terms of service shall be governed by Channelstreem Internal Corporate Policy and Bylaws. User agree that any claim or dispute between user and Channelstreem Corporation, in regards to any of its operating platforms that arises in whole or in part from any platform use shall be for purpose of convenience and practicality decided outside any contested jurisdictional court and be exclusively determined by a Channelstreem Corporation panel of advisors. User agrees to abide by the final opinion of advisors. These Terms of Service, together with the privacy notice and acceptable use policy published here and on each platform, shall constitute the entire agreement between user and Channelstreem concerning the use of platforms. (c) If any provision of these terms of service is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these terms of service, which shall remain in full force and effect. No waiver of any term of this these terms of service shall be deemed a further or continuing waiver of such term or any other term, and (d) Channelstreem failure to assert any right or provision under these terms of service shall not constitute a waiver of such right or provision. (e) Channelstreem reserves the right to amend these terms of service at any time and without notice, and it is user responsibility to review these terms of service for any changes. Continued use of any platform by user following any amendment of these terms of service will signify user assent to and acceptance of its revised terms. (f) User and Channelstreem agree that any cause of action arising out of or related to the use of platforms must commence within one (90) days after the cause of action accrues. Otherwise, such cause of action is permanently barred. (g) User and Channelstreem agree not to sue each other, and instead will resolve their dispute through a decision reached by Channelstreem Corporation panel of advisors. User agrees and accepts as final the decision reached by the panel of advisors and further agrees not to escalate any complaint, claim or dispute any further.
Channelstreem Paid Features Terms of Service
Channelstreem allows you to access certain paid for features or content in exchange for a one-time or recurring fee, as applicable to the relevant platform features or content. The paid access relates to (a) brandstreem.com annual subscription and (b) livestreem.com recurring or one-time fee, or any other features which may be offered by Channelstreem in the future. Your transactions and any other use of the paid features are subject to these Channelstreem paid features Terms of Service.
1. User Acceptance
By using any of Channelstreem platforms paid features, you agree to (1) these paid features Service Terms; and (2) Channelstreem Terms of Service, Privacy Notice, Usage Rules and all other terms and conditions that generally apply to all Channelstreem platforms websites.
2. Payment, Refund and Cancellation Policy
Payment: Channelstreem accept payment using Paypal indicated prior to purchase. Prices for any paid feature may change at any time and Channelstreem does not provide price protection or refunds in the event of a price reduction or promotional offering. User agrees to pay for any paid feature ordered. Channelstreem payment processor will charge additional amounts relating to applicable taxes, bank fees and currency fluctuations. If user purchased any automatically renewing subscriptions, user agree that Payment Processor will charge the payment method on file on the first day of each billing period for the relevant subscription, and if the payment method on file becomes invalid due to an expired credit/debit card or other similar reason and we are unable to charge you on the next billing period, Channelstreem reserves the right to immediately revoke user access to any Paid feature ordered until user update payment method. If user fails to update payment method within a reasonable amount of time, Channelstreem may cancel the paid feature subscription.
Refunds: User can cancel purchase and receive a refund as long as service have not commenced using the relevant paid feature ordered and user make your request no later than 10 working days after order is completed. Requests for refunds must be directed to Channelstreem support team on file. We reserve the right to approve or deny refund requests after 10 working days at our sole discretion. If user receives a refund, Channelstreem reserves the right to terminate user access to the relevant paid feature purchased.
Subscription Cancellations: If user purchased a subscription to a paid feature that automatically renews, user may cancel the subscription any time before the end of the current billing period and the cancellation will take effect on the next billing period. User will retain access to the paid feature from cancelation time until the start of the next billing period, and will not receive a refund or credit for any remaining days in current billing period.
Free Trials: Channelstreem may offer free trials to new paid feature subscription. Channelstreem may cancel user free trial at any time after initial offer expiry.
3. License
Use of the paid features must be only for personal, non-commercial use. User agrees not to use any paid feature, in whole or in part in connection with any public presentation even if no fee is charged as long as such use would not constitute a copyright infringement. If Channelstreem reasonably determines that user violated any of the terms and conditions of the paid feature Terms, rights and access to use the paid feature will immediately terminate without notice and without refund.
4. Restrictions
User of paid feature may not, or attempt to use the paid feature in an illegal manner or for an illegal purpose; Share login credential with others, or allow them access; Copy, sell, rent or sublicense the paid feature to any third party; circumvent, reverse-engineer, modify, disable, or otherwise tamper with any security technology that Channelstreem uses to protect the paid feature or encourage or help other users to do so; access the paid feature other than by means authorized by Channelstreem; or remove any proprietary notices or labels on paid features.
5. Changes or Discontinuation of Paid Services.
Channelstreem reserve the right to change the availability of paid feature. In addition, we reserve the right to modify, suspend, or discontinue any paid feature with or without notice to user and we will not be liable to anyone for any such modifications, suspension, or termination. However, this will not affect use ability to request a refund as described above, if such paid feature is not received for free as part of an offer.
6. Communications and Contact.
User consent to receiving communications from paid feature platform including marketing communications such as newsletters, offers and requests from third parties about user published content, special offers, promotional announcements, and customer surveys to user email address on record or via other methods. If user no longer want to receive such communications, simply unsubscribe.
What is not acceptable content for upload or publication on Channelstreem Platforms
Channelstreem has some standards that outline what is and is not allowed on Channelstreem Platforms. These set standards apply globally to all type of content. They’re designed to be comprehensive and over-encompassing, for example, content that might not be considered hate speech may still be removed for violating other policies, or in the opinion of Channelstreem is not conducive to globally present, safe, secure and enjoyable sharing environment. That said, we weigh heavily on respecting people voice and opinion, the people right to freedom of expression, freedom of speech hold higher ground than political correctness in any decision we make. Even if someone may find a material objectionable, we will allow it is publication if removing it will infringe on content producer right to free speech and freedom of expression. An advantage of Channestreem multi platforms, purpose built structure, is the way we segregated conflicting interests apart. User can choose the proper platform that is perfectly aligned with user’s own interests and / or content. This prevent user exposure to material user has no interest in, or wish not being exposed to any content that conflict with user paradigm.
IMPORTANT NOTICE: Each Channelstreem platform has a particular categories list. Do not upload any content that will not belong to a listed category. If you cannot find a category for your content upload, most likely it does not belong on the platform and will be removed by admin. With the exception of Worldstreem.com the following content is banned on all Channelstreem Platforms:
